1. Applicability

1.1 These General Terms and Conditions (hereinafter: Terms) apply to all offers, orders, and agreements of Kleine Giraf, to the exclusion of any other general terms and conditions. These Terms will be sent to you upon request.
1.2 By accepting an offer or placing an order, you agree to the applicability of these Terms.
1.3 Deviations from these Terms can only be made in writing, in which case the other provisions will remain in full force.
1.4 All rights and claims, as stipulated in these Terms and in any subsequent agreements for the benefit of Kleine Giraf, are also stipulated for the benefit of third parties and intermediaries engaged by Kleine Giraf.

2. Agreement

2.1 An agreement is only concluded after acceptance of your order by Kleine Giraf. Kleine Giraf is entitled to refuse orders or impose specific conditions on the delivery unless otherwise explicitly agreed. If an order is not accepted, Kleine Giraf will inform you within ten (10) working days after receiving the order.

3. Prices/Offers

3.1 All offers from Kleine Giraf are non-binding, and Kleine Giraf expressly reserves the right to change prices, especially when required by (legal) regulations.
3.2 All prices are stated in euros, including VAT, but excluding shipping costs and optional charges.

4. Returns

4.1 All items can be returned within 14 days after receipt without giving a reason (the statutory cooling-off period). The amount already paid (including shipping costs) will be refunded within 14 days. However, it is important that both the items and the packaging are returned in their original condition. We recommend using external packaging for returns. If this is not respected, we will unfortunately not accept the items and cannot refund the payment. For pacifiers and teething toys, the seal must remain intact for hygiene reasons. The return shipping costs are your responsibility. The risk and the burden of proof for the return shipment lie with the consumer.
4.2 You are required to check the delivered goods and quantities. If the quantities do not match or the delivered items are not in order, you must report this to Kleine Giraf by email within 14 days, mentioning the order number in the subject and providing a clear explanation as to why the delivered items do not meet the requirements. Kleine Giraf will replace the items or refund your payment if it is demonstrated that you do not accept the item on valid grounds.
4.3 In the exceptional case that you receive an item that does not match your order, Kleine Giraf reserves the right to replace the item with a new one or refund the paid amount. In this case, Kleine Giraf will cover the return shipping costs.
4.4 If you return an item, please follow these steps:

• Send an email to info@kleinegiraf.nl so we know to expect your return. IMPORTANT: Mention the order or invoice number you received by email in the subject line.
• Package the items carefully to avoid damage to the product and packaging. Damaged items and/or packaging will not be accepted by Kleine Giraf.
• Address the return package to:

  Download the return form, complete it, and include it with your return.

4.5 Unstamped return shipments will not be accepted.

5. Payments

5.1 Payments are processed by Multisafepay. All offered payment methods (iDeal, Credit Card, or bank transfer) are prepaid. Once the payment is received by Multisafepay, Kleine Giraf will proceed with the shipment of your order.

6. Delivery

6.1 The place of delivery is the address that the consumer has entered on the website.
6.2 If the order cannot be delivered by the postal service, the order will be returned to Kleine Giraf, and the order will be considered void. Please refer to the shipping information for further details.
6.3 The delivery times indicated by Kleine Giraf are merely indicative. Exceeding the stated delivery time does not entitle you to compensation. However, if the delivery time exceeds 30 days, you are entitled to cancel the order or terminate the agreement, as necessary. Amounts already paid will be refunded by Kleine Giraf within 14 days.

7. Retention of Title

7.1 The ownership of the delivered products only passes to you once you have paid all amounts owed to Kleine Giraf under any agreement. The risk for the products passes to you at the moment of shipment.

8. Warranty

The warranty is defined according to applicable law, whereby, in case of defects, we may replace or repair the products. If a product cannot be repaired or if the replaced product also shows defects, you may return the products for a full refund of the purchase price.

9. Electronic Communication and Evidence

9.1 Kleine Giraf is not liable for misunderstandings, distortions, delays, or incorrect transmission of data and messages due to the use of the Internet or any other communication medium in the interaction between you and Kleine Giraf (or third parties you have engaged), unless it is due to intent or gross negligence on the part of Kleine Giraf.
9.2 The records of Kleine Giraf serve as full proof of the existence, content, and execution of the agreement with you in any legal proceedings, unless evidence is provided by the party who disputes the reliability of this proof.

10. Force Majeure

10.1 Without prejudice to its other rights, Kleine Giraf has the right, in the case of force majeure, to suspend the performance of your order or terminate the agreement without judicial intervention, by notifying you in writing, without Kleine Giraf being liable for any compensation, unless this would be unacceptable under the given circumstances according to standards of reasonableness and fairness.
10.2 Force majeure refers to any failure that cannot be attributed to Kleine Giraf, because it is not due to its fault and is not her responsibility under the law, legal act, or generally accepted principles.

11. Miscellaneous

11.1 If any provision of these Terms or any other agreement with Kleine Giraf conflicts with applicable law, the relevant provision will be deemed void and replaced by a new provision that is legally permissible and comparable in meaning.
11.2 Kleine Giraf is authorized to use third parties in the execution of your order(s).

12. Applicable Law and Competent Court

12.1 Dutch law exclusively applies to all rights, obligations, offers, orders, and agreements to which these Terms apply, as well as to these Terms.
12.2 All disputes between the parties will be exclusively submitted to the competent court in Rotterdam, the Netherlands.
